1. General provisions.

1.1. The online store https://giftbar.pl/ is run by the Giftbar socket with its registered office in Warsaw at: ul. Aleja Solidarności 95/99, LU5, 00-144, Warsaw. E -mail address: kontakt@giftbar.pl, no. phone: +48 799 843 723.

1.2. The administrator of personal data processed as part of this online store is Giftbar sp.z o.o. Personal data is processed in accordance with the Privacy Policy published on the website, for the purposes, periods and on the grounds indicated therein. The Privacy Policy contains important information on the processing of personal data by the Administrator in the Online Store, including purposes, basics and period of processing of personal data, as well as the rights of data subjects, and detailed information on the use of cookies and analytical tools. Using the online store, including placing orders, is voluntary. Providing personal data by the Service Recipient or Online Store Customer is also voluntary, subject to the situations described in the Privacy Policy (e.g. concluding contracts and fulfilling the obligations arising from legal provisions).

1.3 Definitions:

1.3.1. Contact form - form available on the website for the Service Recipient - quick contact by phone, online Messengry, email address.

1.3.2. Order form - is an electronic service that can be used on the online store website. It allows you to place an order by providing an interactive form, where you can specify details about the recipient and sender. In addition, it allows you to add selected products to the virtual basket and determine the key terms of the sales contract, such as the preferred delivery and payment method.

1.3.3. Customer - the client may be: (1) a natural person with full legal capacity, and in cases provided for by generally applicable provisions also a natural person with limited legal capacity; (2) legal person; or (3) an organizational unit without legal personality, which the Act grants legal capacity - and which has concluded or intends to conclude a sales contract with the seller. In the situation of selling products that are alcoholic beverages, the customer can only be a natural person who is at least 18 years old.

1.3.4. Product - a movable item available in the online store, which is the subject of the sales contract concluded between the customer and the seller. This includes, among others: flower bouquets (including cut flowers, bouquets, wreaths, flower baskets, flower box), balloon sets (latex and foil balloons), gifts, company packaging, company bags, sweets.

1.3.5. Civil Code - Act of the Civil Code of April 23, 1964 (Journal of Laws 1964 No. 16, item 93 as amended).

1.3.6. Regulations - these Online Store Regulations.

1.3.7. Online store - an online store, hereinafter referred to as the "store", is an electronic platform made available by the Service Provider at the internet address: https://giftbar.pl/. The store allows customers to make purchases online, including concluding sales contracts for the products offered in it. The store operates on the principles set out in the regulations, available on the store's main page. The Service Provider reserves the right to make changes to the store's functionality and the products offered in it, as well as to suspend or stop providing services in the Store, subject to the provisions of the Regulations. The use of the Store is voluntary and the customer is obliged to comply with the conditions set out in the Regulations and applicable law when placing orders.

1.3.8. Service Provider/Seller-Giftbar sp.z o.o., with its registered office and address for service: ul. Aleja Solidarności 95/99, LU5, 00-144, Warsaw, entered in the register of entrepreneurs under the KRS number: 0001045401, NIP: 5252962942, REGON: 525759951, e -mail address: kontakt@giftbar.pl, contact number: +48 799 843 723.

1.3.9. Electronic service - the electronic service is provided by the Service Provider to the Service Recipient via the Online Store. This includes all activities undertaken by the Service Provider as part of business operations by means of distance ICT systems, enabling the transfer of data to the Service Recipient's individual order, without the presence of the parties, which means that this service is performed electronically.

The electronic service includes in particular:

1.3.9.1. Sharing an online store that allows the customer to browse the offer and place orders for products.

1.3.9.2. Customer account service, including data management, order history and preferences.

1.3.9.3. Informing the client about new products, promotions and other events related to the store's offer.

1.3.9.4. Providing contact tools with the Service Provider in order to obtain information or technical support regarding the use of the Store.

The electronic service is provided in accordance with applicable law and the rules set out in the regulations of the Online Store. The customer is obliged to comply with the conditions for the provision of electronic services, as well as to maintain the safety and personal data of personal data when using the store.

1.3.10. Sales contract - is a contract concluded or concluded between the Customer and the Seller via the Online Store. This is a legal act under which the seller undertakes to transfer the ownership of the product to the customer, and the customer undertakes to pay the set price. The sales contract includes detailed transaction terms, such as the product description, its quantity, price, payment method, delivery date and other relevant elements set by the parties to the contract.

The terms of the sales contract are described in detail in the regulations of the Online Store and constitute an integral part of the contract. When concluding a sales contract, the customer is obliged to carefully read the terms of the offer and the Store Regulations. The conclusion of the sales contract is tantamount to accepting these conditions.

Upon conclusion of the sales contract, the customer and the seller are obliged to faithfully comply with agreed conditions. In the event of any disputes or ambiguities, both parties are required to take action to resolve them in the spirit of cooperation and compliance with applicable law. The sales contract applies to each transaction made by the online store.

1.3.11. Order - is a statement of the customer's will, placed using the order form available in the online store. It aims to directly conclude a sales contract regarding a given product with the seller. By placing an order, the customer expresses the desire to purchase a specific product on the conditions specified in the description of the product and the regulations of the Online Store.

The order includes key information on transactions, such as:

1.3.11.1. Customer identification - including contact details and information necessary for the proper performance of the order.

1.3.11.2. Product specifications - description, quantity, unit price, selecting the order of the order/product and total value.

1.3.11.3. Selection of payment form and delivery - determining the preferred method of paying the payment and delivery of the product.

The order is placed in a binding manner for the customer. After placing the order, the Customer receives confirmation of the order acceptance in the form of an e-mail and SMS containing relevant information on the transaction. It is also a confirmation of the conclusion of a sales contract between the customer and the seller.

In the event of any changes or deviations from the terms of the sales contract, the customer has the option of consulting the seller to clarify or agree on the details. Placing an order is tantamount to accepting the terms of the sales contract and the regulations of the Online Store. In a situation of doubts or the need for additional information, the customer has the right to contact the store's customer service.

1.3.12. Service Recipient -(1) of a natural person who has full legal capacity, as well as in exceptional cases, provided for by generally applicable provisions, a natural person with limited legal capacity; (2) a legal person; (3) an organizational unit that has no legal personality, but which the Act grants legal capacity.

The Service Recipient is an entity that uses or intends to use the electronic service offered by the Service Provider. As a recipient, he is required to comply with the conditions for the provision of an electronic service, in accordance with the regulations of the Online Store and applicable law.

In the event that the service recipient is a natural person with limited legal capacity, he has the right to use the electronic service only to the extent that it is in line with his legal capacity and with the consent of the statutory guardian. In doubtful situations regarding the authority or obligations of the Service Recipient, it is recommended to consult a statutory guardian or legal specialist.

1.3.13. Consumer Rights Act - Act of 30 May 2014 on consumer rights (Journal of Laws 2014, item 827, as amended).

1.3.14. Newsletter-an electronic service provided by the Service Provider, which enables the Customers to automatically receive, via e-mail e-mail, cyclical content of subsequent editions of the newsletter. It contains information on products, new products and promotions available in the online store.

The use of the newsletter is voluntary and requires a clear consent of the Service Recipient to receive such content. The Service Recipient also has the opportunity to give up subscription at any time, which means stopping to receive subsequent editions of the newsletter.

It is important to respect the applicable law, in particular the provisions on the protection of personal data and the provisions of the provisions of personal data and the provisions of the provisions of personal data and the provisions of commercial information. The newsletter is an effective communication tool, enabling the service providers to provide valuable information about the online store's offer, but also requires concern for privacy and the clear consent of the Service Recipients.

2. Types of electronic services in the online store

2.1. A variety of electronic services are available in the online store, which enable the use of the offer and functionality of the platform. They include, among others: order form, contact and newsletter.

2.2. Order form - the ordering process begins with the entrance to the website of a specific product in the online store. Placing the order consists of two key steps: filling out the order form and confirmation of the purchase by clicking on the "confirm" field on the field of the field. During this time, the customer has the option of independent modification of the entered data. The order form requires providing information regarding the Customer, including the name and name of the company, address, e -mail address, contact phone number, as well as data related to the sales contract and product delivery.

2.1.2.1. The electronic service of the order form is free of charge, is one -off nature and ends with the moment of placing the order or the customer's failure to fail the ordering process.

2.1.3. Newsletter - to use the newsletter, the customer must provide the e -mail address in the "Newsletter" section on the online store's website and click the field to send it. The customer can also sign up for the newsletter by selecting the appropriate field when setting up an account or placing an order. After registering the account and placing the order, the customer will be automatically saved to the newsletter.

2.1.3.1. The Newsletter electronic service is provided without paying and there is no limited date of benefit. At any time, for a justified reason or without giving a reason, the customer may give up the subscription to the newsletter by sending the appropriate request to the Service Provider, in particular to the following address: kontakt@giftbar.pl.

2.2. To use electronic services, it is necessary to meet certain technical requirements. The Service Recipient must have a computer, laptop or other multimedia device with internet access, have an active e -mail account, as well as use the web browser in the current version. In addition, the ability to save cookies and JavaScript support should be enabled in the web browser.

2.3. The Service Recipient is obliged to use the online store in accordance with applicable law and moral standards. Copyright, intellectual property and personal rights of the Service Provider and other third parties should be respected. In addition, all content provided must be lawful.

3. Conditions for the provision of sales contracts

3.1. The conclusion of the sales contract between the Customer and the Seller shall be made after the Customer plays an order using the order form available in the Online Store.

3.2. The price of the product, visible on the online store's website, is expressed in Polish zlotys and contains all applicable taxes. The total amount, including the price of the product with taxes, which is the subject of the contract, including delivery costs (including transport, delivery fees), and any other costs, if their amount is not possible to clearly determine, is given to the client's message on stage of placing the order. In addition, the customer is informed about the obligation to pay these fees at the time he expresses his will to bind the sales contract.

3.3. The procedure for concluding a sales contract in the online store using the order form is as follows:

3.3.1. The sales contract between the Customer and the Seller is concluded after the Customer plays an order in the Online Store, in accordance with the provisions.

3.3.2. After placing the order, the seller immediately sends confirmation of its receipt.

3.3.3. Correction in the content of the order (e.g. change of dedication) can be made until the product is sent to the customer (starting the delivery process).

3.4. In addition, the content of the sales contract is also recorded and secured in the IT system of the Online Store, which further guarantees the integrity of the document.

4. Methods of payment of the presented products

4.1. The seller enables the customer to use various payment methods under the Sales Agreement:

4.1.1. Payment by bank transfer to the seller's bank account.

4.1.2. Electronic payments and payment card payments are carried out via Santander, PayPal, PayU.

4.1.2.1. Transactions made using electronic payments and a payment card are implemented in accordance with the customer's selection.

4.2. Date of payment:

4.2.1. If the Customer is selected by bank transfer, electronic payments or payment by a payment card, the Customer is obliged to make payments within 7 calendar days from the date of the Sales Agreement.

5. Cost, pickup as well as delivery options and dates

5.1. Product delivery is possible in Warsaw and the nearest cities.

5.2. The first attempt to deliver the product is paid in advance. In the case of other products, pickup is possible at:

5.4. Deliveries are carried out from Monday to Sunday, excluding public holidays.

5.4.1. The product is delivered within the time limit indicated by the customer on the calendar available when placing the order.

5.4.2. The delivery takes place daily from 06:00 to 22:00. The customer, when making a purchase, chooses the preferred hourly range of delivery, but on business days the delivery time may change by about 2 hours (e.g. traffic jams) about which the customer will be informed before placing the order or delivery.

5.4.3. On selected days, such as January 21 (Grandmother's Day), February 14 (Valentine's Day), March 8 (Women's Day) and May 26 (Mother's Day), the seller does not guarantee the delivery of goods at the exact time indicated, however, the customer is informed before making an order.

6. Product complaint report

6.1. The seller provides a warranty of freshness for a period of 3 days from the date of delivery for products that are flower parcels, provided that they are properly carried out. In the case of a warranty -based complaint, the customer is obliged to report the defect of the Seller's product within 3 days from the date of receipt. It is recommended that the customer provide photographic documentation of the advertised flowers via e -mail.

6.2. The customer's rights related to a guarantee of freshness do not limit or exclude his right to submit a complaint based on warranty.

6.3. The seller's liability for the physical or legal defects of the product (warranty) is regulated by the provisions of generally applicable law, in particular the Civil Code (Articles 556-576 of the Civil Code).

6.4. The seller is required to provide the customer with a product free from defects.

6.5. The customer has the option of submitting a complaint via e -mail to the following address: kontakt@giftbar.pl.

6.6. The description of the customer's complaint is recommended:

  • information on the product defect, in particular the type and date of its occurrence;
  • requests for the method of bringing the product to compliance with the sales contract, declaration of price reduction or withdrawal from the sales contract;
  • Customer contact details submitting the complaint. This will facilitate and accelerate the process of considering a complaint by the seller. These tips only constitute recommendations and do not affect the effectiveness of complaints submitted without taking into account them.

6.7. The seller will consider the customer's complaint immediately, no later than within 14 calendar days from the date of its notification. If the customer who is a consumer requests an exchange of things or repairing a defect or determines the amount of price reduction, and the seller will not respond to this request within 14 calendar days, this means the customer's acceptance.

6.8. The customer submitting a complaint based on the warranty is obliged to provide a defective product to the following address: ul. Aleja Solidarności 95/99, LU5, Warsaw. In the case of a customer who is a consumer, the costs of delivering a defective product are borne by the seller. If, due to the nature of the product or the manner of its installation, the customer's delivery would be excessively difficult, the customer is obliged to provide the seller's product in the place where he is located.

6.9. Pursuant to art. 558 § 1 of the Civil Code, the seller's liability under the warranty for the product towards the customer who is not a consumer is excluded.

7. Final regulations

7.1. Agreements concluded through the Online Store are prepared in Polish.

7.2. Change of regulations:

7.2.1. The Service Provider reserves the right to make changes to the Regulations for important reasons, such as changes in law, or changes in payment and delivery methods, provided that these changes affect the implementation of the provisions of these Regulations.

7.2.2. In the event of concluding contracts other than continuous contracts on the basis of these Regulations (e.g. Sales Agreement), amendments to the Regulations do not violate the rights acquired by the Service Recipients/Customers before the date of entry into force of the regulations. In other words, changes to the regulations will not affect the already placed orders, sales contracts that are the subject of implementation or already completed.

7.3. The generally applicable provisions of Polish law, in particular the Civil Code, the Act on the provision of electronic services of July 18, 2002 (Journal of Laws 2002 No. 144, item 1204, as amended), Act, Act, acting on matters not covered by these regulations. on consumer rights and other relevant provisions of generally applicable law.

7.4. These Regulations do not exclude the provisions in force in the country in which the consumer having a contract with the service provider/seller has a regular place of stay and which cannot be excluded by contract. The Service Provider/Seller undertakes to provide the consumer with protection resulting from these inalienable law.
